In a significant administrative law ruling today, the Supreme Court of India allowed the Government of Himachal Pradesh to go ahead with its decision to shift the headquarters of the Himachal Pradesh State Commission for Backward Classes from Shimla to Dharamshala, setting aside an interim stay order passed by the Himachal Pradesh High Court. The Bench held that choices about office location are predominantly matters of state policy and generally not amenable to interim judicial restraint.

A three-judge bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice N.V. Anjaria heard the state government’s special leave petition challenging the High Court’s decision to stay the relocation pending final hearing of a public interest litigation.

The High Court had, in a January order, paused the relocation citing concerns over administrative and financial implications of moving the State Backward Classes Commission’s office from Shimla — its long-standing seat — to Dharamshala in Kangra district.

However, the Supreme Court concluded that such choices fall “primarily within the realm of executive policy” and ordinarily do not warrant judicial intervention unless there is a direct constitutional violation or proven impact on fundamental rights.

Senior Advocate Madhavi Divan, appearing for the State, urged that Dharamshala offers logistical advantages and better administrative infrastructure. She highlighted that a significant portion of the State’s backward class population resides in the Kangra region — making the location more accessible and better aligned with the commission’s mandate to serve those communities.

The state also assured that the existing Shimla premises would continue to function as a camp office, especially for the Chairman and scheduled hearings, while the main headquarters operates from Dharamshala.

The PIL before the Himachal High Court, filed by a former commission member, challenged this move as hasty and financially imprudent, pointing to existing leases and staffing constraints in the Shimla office.

The Bench underscored the principle that courts must tread carefully when reviewing executive policy decisions, especially where the action relates to administrative convenience and accessibility rather than clear legal infirmities.
