New Delhi: In a significant judgment that reinforces the democratic fabric of the nation, the Delhi High Court has held that the right of an individual to associate with political parties and be actively involved in politics is a fundamental right protected under Article 21 of the Constitution of India.

The Court observed that any form of coercion or interference with this right by any authority or individual strikes at the very heart of the constitutional guarantees provided to every citizen.

The ruling came from a bench headed by Justice Saurabh Banerjee, while dealing with a matter involving an individual’s right to political affiliation without fear of repercussion. The court was called upon to decide whether "political involvement" could be seen as a restricted activity or if it falls under the broad umbrella of "Personal Liberty" guaranteed by the Constitution.

Justice Saurabh Banerjee noted:

"The right to associate with political parties and being actively involved in politics is protected under Article 21 of the Constitution of India. Any interference or coercion by anyone with such a right strikes at the core of the democratic process."
