In a landmark judgment that reinforces the safety of women in professional environments, the Madras High Court has ruled that protecting women employees from sexual harassment at the workplace is not just a private concern but a "public duty."

Justice Bharatha Chakravarthy, while presiding over a long-standing dispute, made it clear that even organizations like Cooperative Societies—which often claim they are not "the State"—cannot escape their responsibility to ensure a safe work environment for women. The court’s decision effectively ended a painful 25-year legal struggle for a woman employee who was victimized for speaking up against harassment.

The case dates back to the late 1990s. The employee, who joined the Railway Employees Cooperative Credit Society in 1994, alleged that she began facing indecent behavior and sexual harassment starting in 1998 from a newly appointed Assistant Secretary.

When the harassment became unbearable in 2001, she complained to the Chairman. Initially, the management took minor action by stripping the accused official of his powers. However, within just two months, his powers were restored, and the employee was forced into a "hostile work environment."

What followed was a classic case of "victimization." Instead of investigating the harassment fairly, the management issued multiple charge memos against the woman, alleging she wasn't performing her duties properly. The court noted that these charges were "fished out" specifically because she decided to seek justice through the National Commission for Women (NCW) and Human Rights commissions.

One of the most significant legal takeaways from this judgment is the discussion on "Maintainability." The Cooperative Society argued that a Writ Petition (under Article 226 of the Constitution) could not be filed against them because they are not a government body or "State" authority.

Justice Chakravarthy rejected this technical defense. He ruled that the prevention of sexual harassment at the workplace and the protection of women's rights fall within the realm of "Public Duty." Since the society was performing a duty that the law (and the Constitution) demands for the public good, the High Court has the power to intervene.

The Court did not hold back in its criticism of how the management handled the situation. The judge observed that the Chairman of the society failed to understand the gravity of sexual harassment.

The judgment pointed out that the management’s conduct reflected an "unconscious incompetency" of individuals who are products of a "misogynistic society." The court found that the disciplinary actions taken against the woman were a pre-planned attempt to punish her for her bravery in filing a complaint.

Recognizing that the employee had reached the age of retirement (superannuation) while the legal battle was ongoing, the court ruled that the harassment and subsequent victimization entitled her to significant relief.

The Madras High Court directed the Railway Employees Cooperative Credit Society to:

Pay 60% of Back Wages: The employee will receive a substantial portion of the salary she missed out on during the period of her struggle.
Grant Full Retirement Benefits: All pension and retirement funds must be paid to her.
Interest at 6%: To account for the long delay, the management must pay 6% interest on the retirement benefits.

This ruling is a massive victory for women in India, especially those working in smaller organizations, cooperatives, or private setups that often try to bypass the POSH (Prevention of Sexual Harassment) Act guidelines.

By labeling the protection of women as a "Public Duty," the Madras High Court has sent a stern message: any organization, regardless of its legal structure, will be held accountable if it fails to protect its female staff or attempts to victimize them for seeking justice.

After a quarter-century of being labeled a "non-performer" by a hostile management, the employee finally stands vindicated, proving that while the wheels of justice turn slowly, they do eventually reach the right destination.
