In a significant judgment reinforcing the importance of transparency in matrimonial bonds, the Jharkhand High Court has held that a marriage rooted in the concealment of "grave facts"—such as a criminal conviction for murder and a significant age gap—cannot be sustained.

The Division Bench, comprising Justice Sujit Narayan Prasad and Justice Arun Kumar Rai, upheld a divorce decree granted to a husband who discovered after his wedding that his wife was not only much older than disclosed but was also a convict sentenced to life imprisonment for the murder of her former lover.

The Court’s observations touched upon the philosophical and legal bedrock of the institution of marriage. The Bench noted that the relationship between a husband and wife is held together by the "thread of trust."

"Relationship of wife and husband is based on the trust and respect to have upon each other and if it is broken it is non-repairable as the trust is the foundation of marriage. Marriage is a relationship built on mutual trust, companionship and shared experiences," the Court observed.

The legal battle began when Suresh Kumar Sahu (the husband) approached the Family Court in Gumla seeking the dissolution of his marriage to Ranthi Kumari Devi under Section 13 of the Hindu Marriage Act, 1955. The couple had wed on April 15, 2019.

However, the honeymoon period was short-lived. The husband alleged that the entire marriage was vitiated by fraud and the suppression of crucial life details. According to the husband’s petition:

Age Misrepresentation: At the time of the wedding, the wife’s age was disclosed as 27 years. The husband later discovered she was approximately 40 years old.
Criminal Record: The wife had allegedly concealed that she and her brother had been convicted of murder in 2006 (S.T. Case No. 221/2004) and sentenced to life imprisonment. While she was out on bail during her appeal, the husband claimed he was kept in the dark about her two-year stint in jail and her status as a convict.
Pressure and Manipulation: The husband further alleged that his name was altered from "Suresh" to "Ram Sah" to force a horoscope match, and that the marriage was eventually solemnized under pressure.

Beyond the initial deception, the husband testified that the marriage was marked by "mental cruelty." He claimed there was no normal conjugal relationship and that his wife frequently threatened to kill him and his family members. He also alleged that she threatened to implicate him in false criminal cases whenever he questioned her conduct.

In her defense, the wife denied all allegations of concealment. She argued that her age and the details of the pending criminal case (in which she claimed to be falsely implicated) were fully disclosed before the marriage. She further countered by alleging that the husband had suppressed his own past—claiming he had been married twice before—and that she was the one being subjected to harassment.

The Family Court at Gumla, after evaluating the evidence, found merit in the husband’s claims. It concluded that the husband had successfully established "mental cruelty" and granted the divorce in September 2022.

The wife challenged this order in the High Court, arguing that the lower court had ignored her evidence and failed to frame proper legal issues.

Under Section 19 of the Family Courts Act, the High Court has the power to re-examine both the facts and the law of a case. The Bench analyzed various landmark Supreme Court judgments (including Dr. N.G. Dastane vs. Mrs. S. Dastane and Joydeep Majumdar vs. Bharti Jaiswal Majumdar) to define "cruelty."

The Court clarified that while "trivial irritations" or "normal wear and tear" of a marriage do not justify divorce, conduct that is "serious and substantial" and makes living together unreasonable does constitute mental cruelty.

In this case, the High Court found that:

Concealment is a Breach of Trust: Suppressing a life imprisonment conviction and a 13-year age difference is not a "trivial" matter. It goes to the very root of the marital contract.
Mental Agony: Discovering such grave facts after marriage naturally causes immense mental agony to a spouse, making it impossible to continue the relationship.
Behavioral Issues: The wife’s alleged threats of criminal litigation and physical harm further solidified the ground of cruelty.

The High Court concluded that the Family Court’s findings were not "perverse" (legally irrational) and were supported by the evidence on record.

"The conduct of the appellant-wife by concealing the material fact about her age and her conviction of life in a murder case... has caused mental agony to the respondent-husband to such an extent that it is almost impossible for them to live together," the Bench held.

Dismissing the wife's appeal, the Court affirmed the divorce decree, reiterating that a marriage cannot survive once the "thread of trust" has been snapped by the weight of suppressed truths.
