The Karnataka High Court has acquitted a Bengaluru man, Arun Kumar, who was previously sentenced to life imprisonment for the brutal murder of his wife, Ramya. A Division Bench comprising Justice K.S. Mudagal and Justice Venkatesh Naik T held that the prosecution failed to establish a "complete chain of circumstances" necessary for a conviction based purely on circumstantial evidence.

The case, which dates back to 2014, involved the discovery of a severely mutilated body on agricultural land. While the trial court had convicted Kumar in March 2024, the High Court observed that in criminal law, the burden lies heavily on the prosecution to prove guilt beyond reasonable doubt—a standard that was not met in this instance.

On December 30, 2014, a cultivator in Kadusonnappanahalli discovered the body of an unidentified woman. The scene was horrific: the victim’s throat had been slit, limbs were missing, and the skin from the scalp to the chest had been peeled off. These mutilations were allegedly carried out to prevent the identification of the victim.

According to the prosecution, Arun Kumar and Ramya had been in a relationship before marrying in November 2013. The marriage was reportedly troubled from the start. The police claimed that Arun had initially resisted the marriage and only agreed after police intervention when Ramya became pregnant during their courtship.

The prosecution’s motive centered on marital discord and an alleged extramarital affair. They claimed that Arun suspected Ramya’s character and had sent her back to her parental home. During this time, he allegedly developed a relationship with another woman.

A unique aspect of this case was the role of social media. The prosecution alleged that Ramya had posted derogatory messages on Facebook about the woman Arun was reportedly seeing. These posts allegedly included the woman’s personal details and mobile number, causing significant social embarrassment.

The police argued that this prompted a conspiracy. They claimed that on December 29, 2014, Arun lured Ramya to a coffee shop in Kasturi Nagar under the pretext of a reconciliation, took her to an isolated spot in an autorickshaw, and murdered her with the help of accomplices.

While the High Court agreed with the medical evidence that the death was a "homicidal murder," it found several "missing links" in the evidence connecting Arun Kumar to the crime.

1. Inconsistencies in the ‘Last Seen Together’ Theory

The prosecution relied heavily on witnesses who claimed to have seen Ramya with Arun on the night of the murder. However, the High Court found these testimonies unreliable.

The timelines given by witnesses were contradictory.

Statements were recorded months after the incident, casting doubt on their accuracy.

Some key witnesses turned "hostile" (refused to support the prosecution’s story) during the trial.

2. Doubts Over the Recovery of Weapons

The police claimed to have recovered the murder weapons based on Kumar's confession. However, the Court noted that the "Panch" witnesses (independent witnesses required to be present during such recoveries) either turned hostile or were not properly examined. Without independent verification, the recovery of incriminating items carries little weight in court.

3. Failure to Conclusively Identify the Body

Given the severe mutilation, identifying the body was a major hurdle. The prosecution relied almost entirely on a tattoo mark identified by the victim’s mother. The High Court pointed out that despite the technology being available, the police failed to conduct a DNA test to scientifically confirm that the body was indeed Ramya’s.

4. The Burden of Proof (Section 106 of the Evidence Act)

The prosecution tried to use Section 106 of the Evidence Act, which suggests that if a fact is "especially within the knowledge" of a person, the burden of proving that fact is on them. Essentially, they argued Arun should explain what happened to his wife since he was the last one with her.

The High Court rejected this, stating that Section 106 cannot be used to shift the burden of proof to the accused until the prosecution first establishes "foundational facts" linking him to the crime scene.

The Bench emphasized a fundamental principle of Indian criminal jurisprudence: "In a case resting on circumstantial evidence, suspicion, however strong, cannot take the place of proof."

The Court noted that while the crime was undoubtedly heinous, the "chain of events" projected by the police was "laden with deficiency," creating a significant gap that allowed for other possibilities (hypotheses) regarding who committed the crime.

Following these findings, the High Court allowed the appeal and acquitted Arun Kumar of all charges, including murder (Section 302), causing disappearance of evidence (Section 201), and cruelty (Section 498A).

In a compassionate move, the Bench also referred the matter to the District Legal Services Authority to consider providing compensation to the victim’s mother under Section 357A of the CrPC, acknowledging the loss she suffered regardless of the acquittal of the specific accused.
